These Terms of Use govern your access to and use of this website, including any purchases made through the store. By accessing the website or placing an order, you agree to these Terms.
1. About the Store
This website is operated under the artistic name dammit.png.

The store offers original artwork, limited-edition art prints, collectible pieces and, where indicated, commissioned or customised artwork.
2. Products and Limited Editions
Many products offered through dammit.png are produced as limited-edition or collectible art pieces.
Where an edition is described as limited, only the stated number of copies will be made available for sale, except for artist proofs, personal archive copies, replacements required due to shipping incidents, or where otherwise expressly stated.
Availability is not guaranteed until payment has been successfully completed.
Due to differences between screens, printing processes and materials, colours may vary slightly from how artwork appears digitally on the website. These minor variations are not considered defects.
Where prints are individually signed or numbered, minor differences in signatures, numbering or other hand-finished elements are part of the individual nature of the artwork.
3. Orders
By placing an order, you confirm that all information provided during checkout is accurate and complete.
After placing an order, you will receive confirmation using the contact information provided during checkout.
dammit.png reserves the right to refuse or cancel an order in cases including, but not limited to:

incorrect pricing or product information;

suspected fraud or unauthorised transactions;

payment failure;
-
stock errors;
-
technical errors;
-
inability to fulfil the order.
If an order is cancelled by dammit.png after payment has been received, any amount due to the customer will be returned using the original payment method.
4. Prices and Payment
Prices are displayed in the currency indicated on the website.
Any applicable taxes and shipping costs will be shown or communicated before the customer completes the purchase where required.
Customers are responsible for any customs duties, import taxes, brokerage charges or other fees imposed by the destination country unless expressly stated otherwise.
Payment must be successfully completed before an order is processed.
5. Shipping
Orders are shipped to the address provided by the customer during checkout.
The customer is responsible for ensuring that the shipping address is complete and accurate.
Shipping estimates are provided for guidance and are not guaranteed delivery dates. Delays caused by postal services, customs authorities, peak periods, weather, transport disruption or other circumstances outside our reasonable control may occur.

6. Lost Packages
A package will only be considered lost when this can reasonably be established through tracking information, confirmation from the shipping carrier or another verifiable method.
If a shipment arranged by dammit.png is confirmed as lost in transit, we will normally arrange a replacement of the purchased artwork at no additional cost.
Where replacement is impossible, or where applicable consumer law requires another remedy, the situation will be resolved in accordance with those legal requirements.
A delayed shipment is not automatically considered lost.
7. Incorrect Addresses and Failed Deliveries
Customers are responsible for providing a correct and deliverable address.
dammit.png is not responsible for additional shipping costs resulting from:

an incorrect or incomplete address supplied by the customer;

refusal of delivery;
-
failure to collect a package;
-
repeated unsuccessful delivery attempts attributable to the recipient.
If a package is returned to us for one of these reasons, additional shipping charges may be required before it is sent again.
This provision does not limit any mandatory rights available to consumers under applicable law.
8. Returns, Exchanges and Right of Withdrawal
Except where required by applicable consumer law, all sales are final and dammit.png does not voluntarily accept returns or exchanges simply because a customer changes their mind.
Nothing in these Terms excludes or restricts any mandatory right of withdrawal or other consumer right that cannot legally be waived.
Where a statutory right of withdrawal applies, it may be exercised under the conditions and within the period established by applicable law.
Products created according to a customer's specifications or clearly personalised may be excluded from the statutory right of withdrawal where permitted by applicable law.
The limited, signed, numbered or collectible nature of an artwork does not by itself remove any mandatory consumer rights.
9. Damaged, Defective or Incorrect Orders
If an artwork arrives damaged, materially defective or different from the item ordered, contact:
Please include the order information and clear photographs of the product and packaging where reasonably possible.
Eligible cases will be handled in accordance with applicable consumer protection legislation.
Damage caused after delivery through improper handling, storage, framing, exposure to moisture, sunlight or other external factors is not considered a manufacturing defect.
10. Commissions and Personalised Artwork
Commissioned pieces and products made specifically according to a customer's instructions are created individually for that customer.
The scope, price, payment terms, revisions and delivery conditions for commissioned work may be governed by additional terms agreed before work begins.
Once production of a commissioned or clearly personalised artwork has begun, cancellation or withdrawal rights may be restricted or excluded where permitted by applicable law.
11. Intellectual Property
Unless otherwise stated, the original artwork, compositions, website graphics, photographs, animations, videos, text, branding and other original material created by dammit.png are protected by applicable intellectual-property laws.
Purchasing a physical artwork or print does not transfer copyright or commercial reproduction rights to the purchaser.
Unless separately licensed in writing, purchased artwork may not be reproduced, resold as reproductions, commercially distributed, tokenised, used as merchandise, incorporated into commercial products or otherwise commercially exploited.
Ownership of a physical print and ownership of intellectual-property rights are separate.
12. Third-Party Intellectual Property
Certain artworks may contain references to popular culture or third-party intellectual property.
All third-party trademarks, characters, names, logos and intellectual-property rights belong to their respective owners.
Unless expressly indicated, references to third-party intellectual property do not imply sponsorship, endorsement, partnership or official affiliation between dammit.png and the relevant rights holder.
13. Website Use
You agree not to use the website:

for unlawful or fraudulent purposes;

to interfere with its security or operation;

to attempt unauthorised access to systems or information;

to copy or commercially exploit website content without permission;

to submit false payment, identity or delivery information.
Access may be restricted where misuse of the website is detected.
14. Website Availability
We aim to keep the website and its information available and accurate but cannot guarantee uninterrupted or error-free operation.
Products, prices, descriptions and availability may be updated without prior notice.
Nothing in this section excludes liability where exclusion would be prohibited by law.
15. Governing Law
These Terms are governed by Spanish law, without prejudice to any mandatory consumer protections that may apply to customers residing in another jurisdiction.
Where the customer qualifies as a consumer, any dispute will be handled before the courts or authorities competent under applicable consumer-protection and private-international-law rules.
16. Changes to These Terms
These Terms may be updated when necessary to reflect changes to the website, business operations or applicable legislation.
The version applicable to an order will normally be the version in force when the order was placed.
